AGREEMENT TO OUR LEGAL TERMS
We are Dinny & The Explorers (PTY) LTD, doing business as Dinny & The Explorers (‘Company’, ‘we’, ‘us’, or ‘our’), company registration number: 2024/227965/07.
We operate the website www.dinnyandtheexplorers.com (the ‘Site’), as well as any other related products and services that refer or link to these legal terms (the ‘Legal Terms’) (collectively, the ‘Services’).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (‘you’), and Dinny & The Explorers concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood and agreed to be bound by these Legal Terms.
IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU ARE PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.
We will provide prior notice of any scheduled changes to the Services you are using. Modified Legal Terms will become effective upon posting on the Site or notifying you by email. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.
The Services are intended for users who are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Services.
1. OUR SERVICES
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation, or which would subject us to any registration requirement. Users accessing the Services from other locations do so on their own initiative and are responsible for compliance with local laws.
2. PRODUCTS
All products are subject to availability. We reserve the right to discontinue any products or services at any time. Prices for all products and services are subject to change.
3. PURCHASES AND PAYMENT
Accepted forms of payment:
- Payfast
- Direct Electronic Funds Transfer (EFT)
- Cash deposit to our nominated bank account
3.1. To make a booking, you must provide all necessary information requested in the booking form.
3.2. A non-refundable deposit or full payment is required at the time of booking to secure your reservation. Payment must be cleared for confirmation. The remaining balance must be paid in installments according to the payment plan, with the remainder due two months before departure. The trip is confirmed once the full balance is received.
3.3. If full payment is not received by the due date, Dinny & The Explorers reserves the right to cancel your booking without prior notice and cancellation charges will apply.
3.4. Bookings made within two months of departure require immediate full payment. Additional charges may apply for last-minute bookings.
The trip price includes planning, organisation, supplies, accommodation, administration and all items listed in the booking form.

REFUNDS AND CANCELLATION POLICY
Cancellation by the Client
- Airfare bookings: Refunds and cancellation charges are subject to airline rules and may be up to 100% of the fare.
- Travel Package bookings: Cancellation charges imposed by suppliers apply:
- More than 2 months prior to departure: 50% of the package cost (excluding consultation fee)
- Within 30 days of departure: 100% of the package cost (excluding consultation fee)
- More than 2 months prior to departure: 50% of the package cost (excluding consultation fee)
- Partial cancellations may affect the overall package price.
Cancellation by Dinny & The Explorers
Dinny & The Explorers reserves the right to correct errors in package details or cancel confirmed bookings.
Group Trip Minimums:
- Trips may require a minimum number of participants.
- If the minimum is not met, we may cancel the trip and will notify you at least 60 days before departure.
Significant Changes Before Departure:
If a significant change is made to your trip, you may :
- Accept the revised arrangements
- Book an alternative trip of similar or higher standard at no additional cost
- If the alternative is cheaper, the difference will be refunded
- If you choose a different trip, you will pay the applicable price difference
- If the alternative is cheaper, the difference will be refunded
Minor changes do not qualify for these options
Compensation:
No compensation will be due where changes or cancellations are caused by:
- Unforeseeable circumstances beyond our control (force majeure)
- Insufficient bookings
- Failure to meet booking requirements (e.g., non-payment)
- Minor changes
Refund Method and Timeframe:
- Approved refunds will be processed to the original payment method (e.g: EFT, credit/debit card via Payfast).
- Refunds will be issued within 7–21 working days of confirmation.
5. TRAVEL ITINERARY
Itineraries are guides; slight changes may occur due to circumstances beyond our control, such as adverse weather, road conditions, or supplier requirements. Any extra costs due to such events will be agreed upon mutually.
Accommodation:
- Prices are based on double or triple rooms.
- Single-room requests incur an additional surcharge.
Inclusions:
- Flights, accommodation, airport transfers, daily breakfast and activities as per package.
Exclusions:
- Visas, travel insurance, drinks/meals not included, souvenirs, tips, activities outside itinerary, transportation to personal activities.
Flights:
- Booked in economy class on the best route unless otherwise advised.
- Dinny & The Explorers acts as an intermediary; we are not responsible for third-party errors or airline schedule changes.
6. TRAVEL INSURANCE
- We strongly recommend comprehensive travel insurance covering cancellations, medical emergencies, lost baggage and personal liability.
- You are responsible for ensuring coverage is adequate. We are not liable for losses due to inadequate insurance.
7. HEALTH AND SAFETY
- Ensure you are in good health to participate. Consult a healthcare professional if necessary.
- We may deny participation if your health may endanger yourself or others.
8. DUE DILIGENCE
Passport Requirements:
- Please note that it is your personal responsibility to ensure you have a valid passport that does not expire for at least six months after the date of return from the trip.
- The client must ensure that the details supplied to us mirror those details shown on their passport for international travel and ID documents for local travel.
As a guideline, passports should be valid for 6 months after your scheduled return to South Africa.
Check Your Details:
- Travel documents are issued 14–30 days before departure upon full payment.
- Notify us immediately of any discrepancies. We are not responsible for errors after your confirmation.
9. LIMITATIONS OF LIABILITY
We are not liable for any direct, indirect, incidental, consequential, or punitive damages, including lost profits or revenue, arising from your use of the Services.
10. PRIVACY POLICY
We handle personal information with care. By using the Services, you consent to the collection, use, and disclosure of your data in South Africa.
11. INTELLECTUAL PROPERTY RIGHTS
- All Content and Marks on the Services are protected.
- You may use Content for personal, non-commercial purposes only.
- Submissions sent to us become our property, and you grant rights for unrestricted use.
- You are responsible for your Submissions and will reimburse us for any losses caused by breaches.
12. DISCLAIMER
The Services are provided “as-is” and “as-available.” We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement. We are not responsible for third-party products, services, or websites linked to the Services.
